Womans leg amputated by mistake | Virginia medical malpractice lawyer

Grandmother, 72, has leg amputated after hospital wrongly diagnoses cancer

A woman was told she had cancer in her left leg and her leg had to be removed. She got it taken off by the doctor and then test showed that she actually had no cancer in her leg.

A clear case of medical malpratice. I hope people remember this when they ask for tort reform. How much is your leg worth to you? What is your price for permanent disability because a bozo doctor make a horrible mistake?

Should I give a recorded statement to the insurance company? | Virginia personal injury lawyer

I jusy posted a new article about giving a statement to the insurance company about your personal injury car accident claim.

This is never a good idea and you don't need to do it to continue your claim.  The insurance company wants to get your help so they can wreck your accident injury claim. 

I see it all the time.  They just want you to sign a few forms and tell them what happemed.  They use this information to deny you any money for your injuries by digging up all the information they can about your past injuries and using any sort of underhanded tactics they can  get away with using to deny your claim.

Unfortunately most people have no idea that this is happening because they are charmed by the insurance adjuster and they don't realize it until their claim is denied.

Do yourself a favor and get a lawyer if you have been involved in an accident.  At the very least you should read my book Hidden Inside Secrets Big Insurance Companies Don't Want You to Know About Your Injury Claim.

Motorcycle safety tips

I've just posted some motorcycle safety tips for car drivers to avoid causing an accident or motorcycle wreck.

Also I have a new blog post about a recent accident in Virginia involving a truck wrecking into a group of motorcycles and sending several of the drivers to the hospital.

Personal injury cases involving cars and/or trucks hitting motorcycles are almost always really bad for the biker.

One case we had a few years ago involved a motorcycle driving through a tunnel with a tractor trailer beside it.  The trucker suddenly decided to change lanes in the tunnel and the biker had nowhere to go and was horribly injured.

Luckily for the biker we got him a big setlement from the insurance company in his accident claim.

Motorcycle Safety Tips

According to the National Highway Traffic Safety Administration, during the year 2007 motorcycle accident deaths increased by 6.6%, accounting for almost one in eight motor vehicle deaths.  Since May is Motorcycle Safety Awareness Month, we wanted to pass on these safety tips for motorcyclists that was posted at the WHSV.com website:

•    Wear protective gear that provides visibility including a helmet and goggles.  If riding at night, wear bright or reflective clothing.
•    Allow space between you and motorists and never ride side by side with a car in a single lane.
•    Use turn signals before changing lanes and never weave between lanes.

The Motorcycle Safety Foundation provides these additional tips:

Know your motorcycle and how to use it:

•    Get formal training on how to ride a motorcycle and take refresher courses.
•    Call 800.446.9227 or visit www.msf-usa.org to locate the Motorcycle Safety Foundation hands-on RiderCourseSM nearest you.
•    Practice. Develop your riding techniques before going into heavy traffic. Know how to handle your bike in conditions such as wet or sandy roads, high winds, and uneven surfaces.

Last week the Times Dispatch reported an accident in which a Pendleton, West Virginia man by the name of James K. Teter passed away when he lost control of his motorcycle and was struck by an oncoming car on U.S. 33 in Rockingham County.  He was wearing a helmet at the time.

Always be conscious of safety whenever you’re riding in any type of vehicle!

AIG speaks out on Tort Reform


AIG mouthpiece Tiger Joyce, president of the American Tort Reform Association (ATRA) which is funded by AIG and the other robber barons in the insurance industry, has written the latest misleading article on the state of affairs in their attempt to remove the rights of individuals to recover for their injuries (maybe they need more money for another Resort Hideaway where they can badmouth ordinary citizens).

In his article Joyce laments needed changes in the law to help consumers, such as  an attempt to improve “Whistleblower” laws so illegal and unethical behavior can be properly punished. ATRA cares nothing about the consumer interest – but worries only about AIG’s profits (if they ever have any again).

He also complains about expanding Consumer Protection laws. Evidently the bailout money was not enough – Joyce wants us to keep giving to AIG through weak consumer protection laws. How out of touch can you be?
Joyce’s screed continues with complaints about statutes of limitations and statutes of repose – maybe he’s afraid that the insurance industry misdeeds will linger too long into the future, when more evidence may become available.

Helping people to fight off insurance company greed

I have just posted an article about a client of mine, Peggy, that the insurance company tried to rip off. She was badly injured in an automobile accident, but the insurance company didn’t care about her injury. All they wanted to do was to pay her as little as they could get away with. How insurance adjusters really feel about claimants

If you want to know how insurance adjusters really feel about people making legitimate insurance claims, read my recently posted article about how adjusters talk at the claim’s office water cooler. Wrongful death cases

Hi I just added a new library article about wrongful death cases in Virginia.  You can take a look at the text of the law from the code of Virginia as well as some other helpful information about wrongful death.

There are certain things that are conditions for a wrongful death case.  The first condition is that somebody had to die because of something another person did, even if it was an accident.  Next condition is that the person who caused the death must be deemed negligent.  The last condition is that the deceased person must have surviving dependents and/or family members who suffer emotional and/or monetary losses as a result of the death.
 
There are many things that can cause a wrongful death.   The most common causes are car and truck accidents.  Also dog bites, work related deaths while on the job or even propane gas explosions can all be wrongful deaths.

Contingency Fee lawyers

Hi I just added a new article to my library about Contingency Fee Lawyers.  

A lot of people don't realize that a personal injury lawyer does not make any money unless their client makes a recovery on their claim.  In other words, if you don't get paid on your claim then the lawyer doesn't get paid either.
