Minor Death Case Payments Explained | Richmond Virginia Lawyer

I recently posted an article about a case in Hanover County near Richmond, Va about a man who was driving the wrong way down Interstate 295 and killed a man and left his daughters orphaned. It made me think of this case we had a while ago. I thought it might help clarify how minors get their money from insurance settlements.

There was a case we had in North Carolina where the mother of three children was killed and we settled the case. One of the children was an adult, one was about 17 and one was about 15.

So when we settled the case the judge split the settlement three ways so the one who was an adult got 1/3 of the money, the 17-year-old's money got out into a trust for a year and she got the money after she became an adult. The 15-year-old's money was put into an annuity payable a portion of it when they became an adult, another portion of it when they turned 25 and a third portion of it when they turned 30.

Frequently in these types of settlements one of the concerns of the court and the parties involved is the ability of the infant to handle money when they become an adult. The concern of the judge is that a young adult is going to get a large chunk of money and squander it. The courts don't like that. They want the young adults to be a little it more conservative and for that reason the courts will often extend the time in which they get money so that they only get a portion of it when they are a young adult, a portion when they turn 25 and another portion when they turn 30.

The general rule-of-thumb belief is that if they don't have any sense about money by the time they turn 30 they are probably never going to have it.

Insurance Companies are not your friends | Virginia Personal Injury Lawyer

I just talked to a lady on the phone about her accident that happened last year. She told me she was driving down a coutry road, rounded a curve and swerved to avoid hitting a dog. She rolled her jeep five times and it was a miracle that she escped the wreck alive.

She broke her collarbone and her wrist in two places and has had complications from the accident that have caused her to have terrible back problems.

She called us because the insurance company won't return her phone calls and won't pay for her medical treatment that she needs.

She has been trying to deal with them for over a year and get this resolved and when it comes to getting money out of the insurance company she might as well try and get blood from a stone.

Insurance companies are not interested in helping you with your problems. They are for-profit companies that exist to take your insurance premiums and not return the favor when you need them the most.

Your Auto Accident: How Much Money Are You Leaving On the Table?

If you've been involved in an auto accident, are you aware that you're leaving a lot of money on the table when you decide to settle with the insurance companies?  Many people who are involved in car wrecks are not aware that insurance companies will do anything they can to give people as little as possible for their accident injury claim.

Take, for example, a woman who was rear-ended and filed a claim with the other driver's insurance company.  She suffered minor back injury that actually escalated into major back problems months after the accident.  Because she was unaware that insurance companies care more about money than they do about helping injured people, she ended up with only $400 and a host of back problems that went untreated because she didn't have the money to go see a doctor.

If this woman had hired a personal injury lawyer, she probably would have received thousands more dollars for her claim.  Don't make the same mistake that this woman made!  Did you know that:
•    Many physicians or chiropractors will accept a lien whereby their fees are paid out of the amount you receive on your claim.
•    Oftentimes, symptoms of soft tissue injuries do not show up until long after an accident.  That's why it's important to see a doctor immediately following an accident to ensure proper treatment.

If you've been involved in an auto accident in the Richmond, Virginia area, make sure to hire an experienced personal injury lawyer who specializes in helping people with auto accidents

Every Penny Available!

My client Janice R. was a passenger in a vehicle that was hit by an uninsured motorist while driving down Chamberlayne Avenue in northside Richmond, Virginia. Janice had $100,000 in uninsured motorist coverage under her own auto policy. Her own insurance company was being difficult about paying Janice for her injuries even though her medical bills exceeded the coverage they afforded her.

She came to see me and I took over negotiating Janice’s claim. I had a real advantage over Janice when it came to negotiating with her insurance company – I have handled thousands of cases and, of course, this was Janice’s first claim like this.

After wrestling with the adjuster until she realized I was not going to give in to her tricks, we were able to settle the claim for the full $100,000.00 due Janice. Needless to say, she was thrilled with that result. See her video here.

Insurance Companies even pick on little kids!

Insurance adjusters are not above stiffing even little kids. It’s all about money for the insurance boys – to heck with what’s right.  Read my article about how one company treated a small boy who was injured in an automobile collision with his bicycle. Dion was his name and I think you will agree that he deserved better treatment than he got from this greedy insurance company.

Ollie's Story

My client Ollie was just an average guy who was affected by circumstances beyond his control.  His motorcycle accident was caused by a teenage driver's carelessness and his injuries were severe and life threatening.

Ollie was in the right, but the insurance company tried to put him in the wrong. Look at how this company treated my client Ollie who was clearly driving his motorcycle lawfully. His accident and injury were not his fault, but the insurer didn’t want to pay.

People in Richmond and Southside Virginia need to read the details to know how to protect themselves. Read Ollie's story now.

Should I give a recorded statement to the insurance company? | Virginia personal injury lawyer

I jusy posted a new article about giving a statement to the insurance company about your personal injury car accident claim.

This is never a good idea and you don't need to do it to continue your claim.  The insurance company wants to get your help so they can wreck your accident injury claim.

I see it all the time.  They just want you to sign a few forms and tell them what happemed.  They use this information to deny you any money for your injuries by digging up all the information they can about your past injuries and using any sort of underhanded tactics they can  get away with using to deny your claim.

Unfortunately most people have no idea that this is happening because they are charmed by the insurance adjuster and they don't realize it until their claim is denied.

Do yourself a favor and get a lawyer if you have been involved in an accident.  At the very least you should read my book Hidden Inside Secrets Big Insurance Companies Don't Want You to Know About Your Injury Claim.

Helping people to fight off insurance company greed

I have just posted an article about a client of mine, Peggy, that the insurance company tried to rip off. She was badly injured in an automobile accident, but the insurance company didn’t care about her injury. All they wanted to do was to pay her as little as they could get away with. As her accident injury lawyer, I had to bring that insurance adjuster into line. Read the article for more details.

How insurance adjusters really feel about claimants

If you want to know how insurance adjusters really feel about people making legitimate insurance claims, read my recently posted article about how adjusters talk at the claim’s office water cooler. It will make your toenails hurt. Accident and injury victims wouldn’t give these creeps the time of day if they knew how they really talked about them behind their backs.
