Dangerous dog ordinance Richmond, VA | Virginia Dog Bite Lawyer

    Richmond does have a leash law and violation of it can be deemed to constitute negligence.

    There are two different ordinances in Richmond. One ordinance deals with dogs that are considered dangerous and/or vicious through a prior incident involving personal injury or property damage. A dog that has been deemed to be dangerous by a court petition has to wear a tag that identifies it as dangerous, keeping the animal in a secure place at home and making the dog wear a muzzle when the dog is away from home. If the owner does not follow the requirements them Animal Care and Control has the right to take the dog and the court may fine or penalize the dog owner.

    Richmond also has a leash law. Dogs are not allowed to roam free and Animal Care and Control has the right to pick up stray dogs and serve notice to the owners. Also dogs are required to be licensed and vaccinated.

Leesburg, VA Man killed by Pit Bulls

Last Monday a man was found dead from an apparant pit bull attack in Loudon County, Virginia.

Carter Ridge Delaney was found in a house five dogs. Two of the dogs were pit bulls that were covered in blood and acting aggresively. Deleney's wounds were consistent with a dog attack.

The pit bulls were taken to the animal shelter by animal control officers. Virginia law states that a dog that kills somebody may be euthenized by a court order.

It is unfortunate that Mr. Deleney was probably bitten to death by these two dogs. It is unknown what could have been done to prevent this attack. ONce a pit bull bites you it is hard to get off. Their jaws are extremely powerful.

My condolences to Mr. Deleney's family.

Does Your Homeowners Insurance Cover Dog Bites?

According to the National Centers for Disease Control and Prevention in Atlanta ("CDC"), dogs bite nearly 2% of the U.S. population -- more than 4.7 million people annually.

If you own a dog and you're not sure that your homeowners insurance covers dog bites, you probably should check. Even if your dog is highly trained and seems well-behaved, it's important to have homeowners insurance or renters insurance that provides coverage for injuries that are caused by a dog bite.

Most insurance companies do provide at least $100,000.00 for victims of dog bites. Go over your insurance policy carefully. If your insurance company doesn't offer this coverage, it's time to find one that does.

Be aware that currently many companies in the insurance industry are trying to get out of paying claims on dog bites. These companies are now refusing to sell insurance to people with certain breeds of dogs or they are simply excluding dog bites from their coverage.

Dog owners aren't the only ones who may be held responsible for a dog bite or attack. Dog keepers, parents of minors who own the dog, and even landlords who were aware that a tenant owned a dangerous dog could be liable to the injured party.

Culpeper, Virginia Child Mauled By Roving Dogs

We have a new article about a vicious dog attack on a young child in Culpeper, Virginia by roving pit bull dogs.

Roving dogs can be a problem in rural areas. In Virginia it is up to the localities to make their own leash laws so they can vary from area to area around the state.

The Virginia Code states:

Citation: Va. Code Ann. § 3.2-6539 (formerly cited as Va. Code Ann. § 3.1-796.95)

Summary: This Virginia statute provides that the governing body of any city may adopt regulations or ordinances requiring that dogs to be kept on a leash or otherwise restrained and may request the court to order a referendum as to whether any such ordinance so adopted shall become effective in the city. The results of the referendum shall not be binding upon the governing body of any such city but may be used in ascertaining the sense of the voters.

Statute in Full:

The governing body of any locality may adopt ordinances requiring that dogs within any such locality be kept on a leash or otherwise restrained and may, by resolution directed to the circuit court, request the court to order a referendum as to whether any such ordinance so adopted shall become effective. Such referendum shall be held and conducted, and the results thereof ascertained and certified in accordance with § 24.2-684. The court shall require the governing body to give appropriate notice of the time, place and subject matter of such referendum.

The results of the referendum shall not be binding upon the governing body of the locality but may be used in ascertaining the sense of the voters.

Avoid Dog Bites in Richmond, Virginia: National Dog Bite Prevention Week | Lawyer Wayne O'Bryan

The United States Postal Service (USPS) has launched the National Dog Bite Prevention Week which will take place the week of May 18-24. Given that thousands of postal carriers across the nation have been attacked and bitten by dogs, we can understand why they would promote this initiative.

We urge you to be a responsible dog owner. Follow these tips in order to avoid dog bites:

•    Put your dog(s) through obedience training in order to teach them proper behavior. This training also helps you control your dogs.
•    If a postal carrier comes to your door, keep your dog inside.
•    Don’t allow your child to take mail from the postman in front of your dog. The dog’s instinct is to protect you and your family.
•    Spay or neuter your dog. Dogs that are fixed are less likely to bite.
•    Dogs that receive attention and affection are less likely to bite or attack people.
