A recent article in the LA Times shows the problem with tort reform and how the only people who really benefit from it are the insurance companies.
The insurance companies would love to avoid any sort of health care reform that might cut into their enormous profits and just focus the debate on tort reform.
I hear a lot about "frivolous lawsuits", but any lawyer would be a fool to knowingly take on a case he or she thinks is frivolous. The main reason being that most lawyers get paid on a contingency fee basis so that if the lawyer does not get a settlement for his client, then the lawyer does not get paid.
