I'm in the process of settling with the insurance company over my minimally displaced comminuted fracture. Since negotiating with insurance adjusters is done on an uneven playing field, I can see why people feel the need to hire lawyers.

My insurance adjuster sent a check for my medical expenses made out to me and my HMO. My understanding, which I think you supported, is that my HMO cannot recover this under subrogation from a Virginia resident. I am waiting to hear back from the HMO for confirmation.

We just got a bad case in where our client had somebody supposedly taking care of his bills but in reality their insurance had lapsed and his license had been suspended.

He got in a bad auto accident when somebody ran a red light and hit him broadside in a t-bone wreck. Now there is a question if the person who hit our client has enough insurance to cover all of our client's medical bills.

I recently posted an article about a case in Hanover County near Richmond, Va about a man who was driving the wrong way down Interstate 295 and killed a man and left his daughters orphaned. It made me think of this case we had a while ago. I thought it might help clarify how minors get their money from insurance settlements.

There was a case we had in North Carolina where the mother of three children was killed and we settled the case. One of the children was an adult, one was about 17 and one was about 15.

So when we settled the case the judge split the settlement three ways so the one who was an adult got 1/3 of the money, the 17-year-old's money got out into a trust for a year and she got the money after she became an adult. The 15-year-old's money was put into an annuity payable a portion of it when they became an adult, another portion of it when they turned 25 and a third portion of it when they turned 30.

Frequently in these types of settlements one of the concerns of the court and the parties involved is the ability of the infant to handle money when they become an adult. The concern of the judge is that a young adult is going to get a large chunk of money and squander it. The courts don't like that. They want the young adults to be a little it more conservative and for that reason the courts will often extend the time in which they get money so that they only get a portion of it when they are a young adult, a portion when they turn 25 and another portion when they turn 30.

The general rule-of-thumb belief is that if they don't have any sense about money by the time they turn 30 they are probably never going to have it.

Recently a jury in Massachusetts awarded $15 million to the parents of a three-year-old Jason Fox who died after a series of complications following open-heart surgery.

There are hundreds of thousands of people who are killed or injured each year due to medical malpractice and this case was especially bad in my opinion because the doctors tried to cover-up their mistakes and lied to the parents about what had really happened to cause Jason's death.

Thus in their effort to use their credentials as a shield to cover up their error, they made a already tragic situation even worse. One of the doctors even yelled out during cross-examination "I don't make mistakes!"

But even doctors make mistakes and sometimes their mistakes kill innocent people who come to them for help. Or sometimes it leads to things like surgery performed on the wrong body part and other horrible things.

Lowest Car Accident Deaths in Virginia in over 40 years

Virginia had 821 traffic fatalities in 2008, the lowest number of car deaths since 1966. 2009 should have a significantly lower number of deaths than 2008.

This is likely due to several things, the most important being the increased amount of people using their seat belts. Seat belts are very important to use every time you are in the car and are a good habit to start. About 82% of Virginians buckle up and we should try and make it 100% before the end of the next decade.

Also there continues to be analysis of the causes of car wrecks and ways to prevent accidents. This data allows traffic engineers to change traffic patterns, add or remove stop lights, change speed limits and help police locate problem areas.

Also there has been an effort by Virginia Governor Tim Kaine to fund traffic safety programs to reduce the number of traffic deaths by increasing seat belt usage, deterring drunk and/or aggresive drivers, reducing motorycle, bike and pedestrian deaths, and increasing awareness of risks for teen and senior citizen drivers.

Colonial Heights, VA woman convicted of killing moped driver while driving drunk

Megan Lean Brown pleaded guilty of involuntary manslaughter while driving drunk, maining while driving drunk and DUI in Chesterfield County Circuit Court on Monday. She may face up to 16 years in prison when sentenced.

In June 13, Brown killed Frederick Scott Wall and critically injured his passenger Ricky Lynn Hill as the were riding their mopeds on Jefferson Davis Highway near Route 288.

Brown was driving the wrong direction on Jeff Davis Hwy about 3am when she hit the moped head-on. Wall was pronounced dead at the scene. Hill suffered fractured pelvis, head trauma, partial paralysis, and nerve and muscle damage. Hill is still trying to recover from the accident. Hill is in a wheelchair and has trouble speaking.

Wall's family is elligible to file a wrongful death lawsuit against Brown for her negigent actions, and they should probably take steps to begin their suit before the statute of limitations gets any closer. Also Brown could be sued for the injuries that she inflicted on Mr. Hill in this terrible accident.

What a terrible accident that has ruined three lives all because one person made some really poor decisions.

Richmond VA Invests Least in Pedestrians

In the last 15 years more than 76,000 American pedestrians have been killed, mostly children, the elderly and ethnic minorities. Most of these accidents happened on roads that were not designed for pedestrian traffic. People that get hit by cars often die and rarely escape serious personal injury.

Transportation for America has released a new study last Monday called Dangerous By Design that looks at ways to fix problems in pedestrian transportation infrastructure.

Richmond, VA was the most dangerous city in the commonwealth for pedestrians, ranking 24 out of 52 cities in the US with a population of a million or more. Richmond also spends less money than any of the cities on infrastructure for pedestrian and bicycle use.

This is easy to see in the Richmond area. There are many roads with no sidewalks at all and very few bike paths. It is no wonder that it is so dangerous to walk in Richmond. I frequently see pedestrians and bicyclists in the street because there is no where else for them to travel.

Instead of dumping more money into supporting cars, it is time to start thinking of alternatives. There are more people than ever looking for a different way to travel. It is time to sttart spending money on their safety.

Make sure that you don't drive when you are sleepy. It is better to pull off the road and take a nap than to risk wrecking your car. Sleepy drivers cause thousands of accidents each year and it can be worse than driving drunk.

A woman was told she had cancer in her left leg and her leg had to be removed. She got it taken off by the doctor and then test showed that she actually had no cancer in her leg.

A recent article in the LA Times shows the problem with tort reform and how the only people who really benefit from it are the insurance companies.

The insurance companies would love to avoid any sort of health care reform that might cut into their enormous profits and just focus the debate on tort reform.

I hear a lot about "frivolous lawsuits", but any lawyer would be a fool to knowingly take on a case he or she thinks is frivolous. The main reason being that most lawyers get paid on a contingency fee basis so that if the lawyer does not get a settlement for his client, then the lawyer does not get paid. That is the way we work, and most lawyers are the same.

Believe it or not, most lawyers are ethical and are trying to help people get money from insurance companies that do not want to pay a fair settlement to a person who has suffered real injuries.

    Richmond does have a leash law and violation of it can be deemed to constitute negligence.

    There are two different ordinances in Richmond. One ordinance deals with dogs that are considered dangerous and/or vicious through a prior incident involving personal injury or property damage. A dog that has been deemed to be dangerous by a court petition has to wear a tag that identifies it as dangerous, keeping the animal in a secure place at home and making the dog wear a muzzle when the dog is away from home. If the owner does not follow the requirements them Animal Care and Control has the right to take the dog and the court may fine or penalize the dog owner.

    Richmond also has a leash law. Dogs are not allowed to roam free and Animal Care and Control has the right to pick up stray dogs and serve notice to the owners. Also dogs are required to be licensed and vaccinated.

Child Wrongful Death Medical Malpractice Case

There is a new lawsuit filed by Davis Law Group in Seattle regarding the wrongful death of an autistic 15-year-old named Michael Blankenship due to a clear case of medical malpractice.

Blankenship was accidentally prescribed a painkiller-laced patch that led to his death by drug overdose. The patch contained a drug called fentanyl and had the highest dose available, a dosage that is usually given to relieve chronic pain in cancer patients.

Blankenship went to bed with the patch applied after having routine dental surgery that day and died in his sleep that night.

According to the FDA, the fentanyl patch has been a problem in the past few years and has led to many deaths and life-threatening injuries and side-effects. Doctors have been prescribing the patch for inappropriate purposes, such as headaches and occasional mild pain.

In my opinion, this is a clear case of medical negligence that led to a child's death and the Seattle Children's Hospital should be held accountable for this tragedy. Imagine how you would feel if your child went to the hospital for routine dental work and died in his sleep that night due to drug overdose.

The hospital medical director Dr. David Fisher says "There has not been any discilpine in this case, nor will there be." and "No one along the chain realized that this was not our standard practice."

Hopefully this hospital will pay for their error and it will help them remember that they made a tragic mistake that led to a senseless death.

Family struggles after car accident with drunk driver

Last December, Annie Roach and her nine-year-old son Jarod Roach were injured in a car accident when their 2003 Mitsubishi Galant was struck by a 1993 Ford Explorer being driven by a drunk driver named Helen Jewel Ward.

Jarod suffered a broken pelvic bone and bruises on his face. His mother fared much worse with a collapsed lung, broken jaw, torn aorta, broken kneecaps, internal bleeding and a crushed ankle. At one point her heart stopped and had to be shocked back into working.

The family's life still hasn't returned to normal over nine months after the accident. The family is survivng on an insurance settlement and the future looks uncertain. The family spends $650 a month on Annie's physical therapy and medicine, and they have yet to pay any hospital bills as the father of the family has been unable to find a job.

I don't know how much they got for their accident injury claim settlement, but whatever it was, I'm sure it was inadequate to compensate the family for their pain and suffering.

I just talked to a lady on the phone about her accident that happened last year. She told me she was driving down a coutry road, rounded a curve and swerved to avoid hitting a dog. She rolled her jeep five times and it was a miracle that she escped the wreck alive.

She broke her collarbone and her wrist in two places and has had complications from the accident that have caused her to have terrible back problems.

She has been trying to deal with them for over a year and get this resolved and when it comes to getting money out of the insurance company she might as well try and get blood from a stone.

Leesburg, VA Man killed by Pit Bulls

Last Monday a man was found dead from an apparant pit bull attack in Loudon County, Virginia.

Carter Ridge Delaney was found in a house five dogs. Two of the dogs were pit bulls that were covered in blood and acting aggresively. Deleney's wounds were consistent with a dog attack.

The pit bulls were taken to the animal shelter by animal control officers. Virginia law states that a dog that kills somebody may be euthenized by a court order.

It is unfortunate that Mr. Deleney was probably bitten to death by these two dogs. It is unknown what could have been done to prevent this attack. ONce a pit bull bites you it is hard to get off. Their jaws are extremely powerful.

My condolences to Mr. Deleney's family.

Driver charged with manslaughter after fatal car accident

The fatal car crash of July 7 that led to the death of a passenger in a 2000 Ford Crown Victoria that hit a flatbed wrecker truck making a legal turn has led to the arrest of the car driver who caused the accident.

Cordell Hall has been charged with manslaughter for the death of Dennis Smith, who died at the scene of the accident.

Investigators found that Hall drve through a red light at a high rate of speed and hit the truck making a legal turn from Hull Street onto Belt Boulevard in Richmond, Virginia.

Another sad example of a wrongful death caused by somebody else's fault.

Southside, VA head on collision

Another head-on collison in southside Virginia last Thursday sent two people to the hospital. The wreck happened on Route 92 near route 600 just after noon, according to Virgina State Police.

A 1991 Toyota Camry driven by Elizabeth Hatcher of Victoria, VA crossed the center line and hit a 2006 Hyundai Sonata driven by Regina Smith of Red Oak, VA head-on.

Hatcher was charged with failure to maintain control.

Another example of what was probably a small error or lapse in attention leading to a severe accident and personal injury for a couple of unsuspecting people. Those two-lane country roads in rural Virginia are unforgiving and dangerous.

There was a wreck last Thursday around 5pm in Southside, VA on Route 138 near routh 649. Four people were hurt and taken to local hospitals, according to Virginia State Police.

The accident happened when a 1997 Ford Explorer driven by Latisha Farrar of Victoria, VA crossed the center line, sideswiped a 1989 GMC andura and hit a 2002 Pontiac Grand Prix, driven by Daniel Nowlin, head-on.

Nowlin and his passenger, Melissa Garrison, were both airlifted from the scene of the accident to an unspecified hospital.

There are a lot of bad wrecks in southside Virginia because there are so many two-lane roads with no median. This leads to a lot of head-on collisions which are the worse type of wreck.

I just posted the Virginia law about wrongful death straight from the Code of Virginia. I wanted to put this out there for those of you who can read legalese.

In upcoming weeks I will be translating the law into layman's terms so the average person can understand the law on wrongful death in Virginia.

The current Virginia laws on wrongful death were written in 1950 and adapted from The Fatal Accidents Act 1846 (9 & 10 Vict. c.93), commonly known as Lord Campbell's Act. Prior to this there was no way to get compensation for wrongful death because a dead person can not make a claim in court. A very strange way of thinking if you ask me.

According to the National Centers for Disease Control and Prevention in Atlanta ("CDC"), dogs bite nearly 2% of the U.S. population -- more than 4.7 million people annually.

If you own a dog and you're not sure that your homeowners insurance covers dog bites, you probably should check. Even if your dog is highly trained and seems well-behaved, it's important to have homeowners insurance or renters insurance that provides coverage for injuries that are caused by a dog bite.

Most insurance companies do provide at least $100,000.00 for victims of dog bites. Go over your insurance policy carefully. If your insurance company doesn't offer this coverage, it's time to find one that does.

Every year hundreds of people are killed or injured on Virginia's roads and highways. According to the Accidents.com website, there were 963 people involved in fatal accidents in Virginia during 2006. Of these deaths, 17 were killed on expressways or freeways in Virginia while 144 fatalities involved local Virginia roads.

In order to help prevent an increase in these statistics, we'd like to share some tips on how to prevent auto accidents:
•    Make sure your car is properly maintained on a regular basis. Inspect your tires weekly and change the oil according to the manufacturer's recommendation.
•    Always, always, always wear your seatbelt. Even if you're just going around the block or down the street, put on that seatbelt. They say that most car accidents happen within 1.4 miles from the home.
•    Get plenty of sleep before taking a road trip. If you plan on driving a long distance, take frequent rest breaks.
•    Know what the road conditions are before you drive and plan accordingly.
•    Do not drink and drive. Period.
•    Do not use your cell phone while driving. If you absolutely must use your phone, make sure to use a hands-free device.
•    Do not speed in order to get somewhere on time. Other people can get over you being late. Wouldn't you rather get there late than not at all?

One of the best ways to prevent car accidents in Virginia (or anywhere else, for that matter) is to create awareness and educate people, especially young drivers, about driving safe. Do everyone a favor and pass on this article to friends and family!

This is never a good idea and you don't need to do it to continue your claim. The insurance company wants to get your help so they can wreck your accident injury claim.

I see it all the time. They just want you to sign a few forms and tell them what happemed. They use this information to deny you any money for your injuries by digging up all the information they can about your past injuries and using any sort of underhanded tactics they can get away with using to deny your claim.

Unfortunately most people have no idea that this is happening because they are charmed by the insurance adjuster and they don't realize it until their claim is denied.

Motorcycle safety tips

I've just posted some motorcycle safety tips for car drivers to avoid causing an accident or motorcycle wreck.

Also I have a new blog post about a recent accident in Virginia involving a truck wrecking into a group of motorcycles and sending several of the drivers to the hospital.

Personal injury cases involving cars and/or trucks hitting motorcycles are almost always really bad for the biker.

We have a new article about a vicious dog attack on a young child in Culpeper, Virginia by roving pit bull dogs.

Roving dogs can be a problem in rural areas. In Virginia it is up to the localities to make their own leash laws so they can vary from area to area around the state.

The Virginia Code states:

Citation: Va. Code Ann. § 3.2-6539 (formerly cited as Va. Code Ann. § 3.1-796.95)

Summary: This Virginia statute provides that the governing body of any city may adopt regulations or ordinances requiring that dogs to be kept on a leash or otherwise restrained and may request the court to order a referendum as to whether any such ordinance so adopted shall become effective in the city. The results of the referendum shall not be binding upon the governing body of any such city but may be used in ascertaining the sense of the voters.

Statute in Full:

The governing body of any locality may adopt ordinances requiring that dogs within any such locality be kept on a leash or otherwise restrained and may, by resolution directed to the circuit court, request the court to order a referendum as to whether any such ordinance so adopted shall become effective. Such referendum shall be held and conducted, and the results thereof ascertained and certified in accordance with § 24.2-684. The court shall require the governing body to give appropriate notice of the time, place and subject matter of such referendum.

The results of the referendum shall not be binding upon the governing body of the locality but may be used in ascertaining the sense of the voters.

Motorcycle Safety Tips

According to the National Highway Traffic Safety Administration, during the year 2007 motorcycle accident deaths increased by 6.6%, accounting for almost one in eight motor vehicle deaths. Since May is Motorcycle Safety Awareness Month, we wanted to pass on these safety tips for motorcyclists that was posted at the WHSV.com website:

•    Wear protective gear that provides visibility including a helmet and goggles. If riding at night, wear bright or reflective clothing.
•    Allow space between you and motorists and never ride side by side with a car in a single lane.
•    Use turn signals before changing lanes and never weave between lanes.

The Motorcycle Safety Foundation provides these additional tips:

Know your motorcycle and how to use it:

•    Get formal training on how to ride a motorcycle and take refresher courses.
•    Call 800.446.9227 or visit www.msf-usa.org to locate the Motorcycle Safety Foundation hands-on RiderCourseSM nearest you.
•    Practice. Develop your riding techniques before going into heavy traffic. Know how to handle your bike in conditions such as wet or sandy roads, high winds, and uneven surfaces.

Last week the Times Dispatch reported an accident in which a Pendleton, West Virginia man by the name of James K. Teter passed away when he lost control of his motorcycle and was struck by an oncoming car on U.S. 33 in Rockingham County. He was wearing a helmet at the time.

The United States Postal Service (USPS) has launched the National Dog Bite Prevention Week which will take place the week of May 18-24. Given that thousands of postal carriers across the nation have been attacked and bitten by dogs, we can understand why they would promote this initiative.

We urge you to be a responsible dog owner. Follow these tips in order to avoid dog bites:

•    Put your dog(s) through obedience training in order to teach them proper behavior. This training also helps you control your dogs.
•    If a postal carrier comes to your door, keep your dog inside.
•    Don’t allow your child to take mail from the postman in front of your dog. The dog’s instinct is to protect you and your family.
•    Spay or neuter your dog. Dogs that are fixed are less likely to bite.
•    Dogs that receive attention and affection are less likely to bite or attack people.

AIG speaks out on Tort Reform

AIG mouthpiece Tiger Joyce, president of the American Tort Reform Association (ATRA) which is funded by AIG and the other robber barons in the insurance industry, has written the latest misleading article on the state of affairs in their attempt to remove the rights of individuals to recover for their injuries (maybe they need more money for another Resort Hideaway where they can badmouth ordinary citizens).

In his article Joyce laments needed changes in the law to help consumers, such as an attempt to improve “Whistleblower” laws so illegal and unethical behavior can be properly punished. ATRA cares nothing about the consumer interest – but worries only about AIG’s profits (if they ever have any again).

He also complains about expanding Consumer Protection laws. Evidently the bailout money was not enough – Joyce wants us to keep giving to AIG through weak consumer protection laws. How out of touch can you be?
Joyce’s screed continues with complaints about statutes of limitations and statutes of repose – maybe he’s afraid that the insurance industry misdeeds will linger too long into the future, when more evidence may become available.

Virginia Governor Passes Law That Bans Texting While Driving

Nowadays text messaging has become a common way for people to communicate. But did you know that text messaging while driving is widely considered one of the most dangerous things to do while operating a motor vehicle? In fact, The Transport Research Laboratory in the UK found that drivers who send text messages while driving dramatically increase the likelihood of collision. Their reaction times decreased by 35%, which is worse than those who drank alcohol at the legal limit. Teens say that texting is their No. 1 driving distraction, according to a 2006 study from Liberty Mutual Research Institute for Safety and Students Against Destructive Decisions (SADD).

Earlier this month Virginia Governor Timothy Kaine signed into law a ban on text messaging while driving. The new law will take effect on July 1, 2009. Virginia will become one of many states that have banned texting while driving. The ban will include text messaging while driving a car, bicycle, motorcycle, moped or even an electric wheelchair.

The bill, sponsored by Del. John A. Cosgrove, would make texting a secondary violation. This means that a driver could get only a $20 ticket for the offense if pulled over for another reason. Second and subsequent texting-while-driving offenses would result in fines of $50.

Virginia and Maryland have considered banning the use of cellphones for adult drivers almost every year since at least 2001. Maryland banned cellphone use for teens with learner's permits in 2005, and Virginia made it illegal for drivers younger than 18 in 2007.

Fog Causes Major Car Accident on Interstate 81 | Virginia tractor trailer truck accident lawyer

Recently foggy conditions caused a fiery car accident on Interstate 81 near Woodstock. The crash involved three tractor trailers and one car in which three people died, including two men were from Edinburg, Virginia.

According to DailyPress.com, a southbound tractor trailer had slowed down because of the fog and was hit in the rear by another tractor trailer. The car slowed because of the collision and was hit in the rear by the third truck. One of the trucks was carrying corrosive materials that caused the fire.

Fog can reduce visibility to 1/4 mile or less and accidents can occur regardless of your driving experience. If you have to drive through dense fog, follow these tips:
•    Slow down. Drive at a speed that feels comfortable to you.
•    If you have to drive through very dense fog, keep your low beams on. Do not drive with the high beams on because this can blind other drivers who are coming from the opposite direction.
•    Keep a safe distance between you and the car ahead of you.
•    If the fog becomes too dense, pull over to the side of the road and wait until the fog clears up a little before proceeding.
•    Avoid passing other cars.
•    Do not drive with your hazard lights on. This can be distracting to other drivers.
We highly recommend not driving at all if it’s foggy outside. No trip is worth a car accident.

Our earlier post "Auto Accident in Virginia, Tips For Carrying Items On Top of a Car."
has caused some controvery and I want to clarify the situation with new information from the families involved. According to the Daily Press, Virginia State Police had reported that there was luggage in the middle of Interstate 295 near Richmond, Virginia when the accident occured.

But O'Bryan Law has learned that the SUV that was struck in this horrible accident was off the road with their flashers on and checking their luggage on top of their vehicle. The luggage had not fallen off the vehicle at all. Out of nowhere, a woman (who later received a ticket for driving recklessly) crossed two lanes of traffic, struck the rear of the SUV and killed the victim instantly.

This is a very tragic accident that leaves behind a family still dealing with grief and we apologize for the wrongful death misinformation.

This seems to be an example of a driver not paying attention when driving. There are so many distractions that can cause you to have an accident, When you are diving at a high rate of speed on an interstate the difference between life and death can be very small and you need to pay full attention to the road.

You must also not trust that the drivers around you are paying attention. Every day I see people doing other things while driving, like talking on a cell phone, eating, reading or texting. These people could hit you in an unfortunate careless moment. Drive with a wary attitude.

Another good rule of thumb is: when in doubt yield. Better to yield to a carless or clueless driver than to end up with a personal injury or death.

2. Call the police and have them review the scene of the accident. This is an important step especially if there are any injuries or misunderstandings as to who was at fault. Officers may not respond if there are no injuries, so take a picture of the accident scene instead.

3. Report the accident to your auto insurance company. Even if you're not at fault, it's good to review what your policy covers just in case the other drive does not have insurance. Remember that it is legal for a motorist to drive in the state of Virginia without auto insurance.

4. See a doctor or chiropractor. Perhaps you think the accident was minor and you didn't experience any pain, but it's still important to see a doctor. People's bodies handle car accidents in different ways. Hi I just added a new library article about wrongful death cases in Virginia. You can take a look at the text of the law from the code of Virginia as well as some other helpful information about wrongful death.

There are certain things that are conditions for a wrongful death case. The first condition is that somebody had to die because of something another person did, even if it was an accident. Next condition is that the person who caused the death must be deemed negligent.
